Delta Crib Recall Lawsuit

A defective design in the drop-side style cribs sold since 1995 by Delta Enterprise Corp., is responsible for at least two infant deaths, and may have been responsible for many more crib related injuries and fatalities. Recently the U.S. Consumer Product Safety Commission (CPSC) published information on it's website regarding the recall of two crib models which effect over 1,585,000 Delta cribs. The CPSC states that the recall is due to the problems discovered with the safety and spring pegs.

The Delta crib recall includes over 985,000 drop side style cribs that poses the risk of entrapping and suffocating botth toddlers and infants if a safety peg located in the bottom of each leg is missing. If the safey peg is not located within the bottom track, the crib can potentially come loose and detach, when lowered below the peg hole, which creates a dangerous gap.

The cribs included in the recall were sold between the dates of December 2005 and September 2007 for around $100 at many major retailers, including Kmart, Wal-Mart and Target. The cribs are also widley resold second hand, which increases the chance of the removable safety peg missing since many of these second hand cribs had to be re-assembled. The second Delta drop side crib recall includes over 600,000 cribs. These cribs contain a spring peg, instead of a safety peg. Due to a defect in the design, the spring peg can fail to engage, which causes the risk of entrapment and suffocation as well. The spring peg, located at the bottom of each leg, can become nonfunctional, which allows the drop down side of the crib to detach.

The spring peg cribs were sold at retail stores between January 2000 and January 2007 and cost up to $200. They contain the “Delta” company name on the support boards for the matress and teether rail as well. The model numbers for the second recall cribs are:

The U.S. CPSC has confirmed that they have been made aware at least two infant fatalities which were caused by the Delta drop side cribs. An 8 month old infant suffocated when the drop side of his crib became detached and another baby was trapped due to a spring peg that was disengaged.
